On a petition  moved by Lucknow based Social Activist Urvashi Sharma under 156(3) CrPc, the court of Judicial Magistrate II  has directed the Ashiyana Police Station of State Capital to enquire the matter of filing of  First Information Report (FIR) against Subrat Roy and Sahara India Parivaar and submit report by 22-05-13. The next date of hearing is 23-05-2013.

 


According to the petition filed by Urvashi Sharma, a Lucknow based social Activist,on 06-05-13(Monday) , SAHARA India Parivaar had organized " Bharat Bhavna Divas" at Ramabai Ground in Lucknow. Later Urvashi came to know through newspaper-reports that the National Flag (Tricolor) was grossly dishonored at the venue of the program. According to Urvashi, the organizers of the said feat were solely responsible for this act of gross disrespect to national flag of India and that the Organizers should have acted responsibly and should have made adequate arrangements so as to avert any such situation. If they were not able to manage it, they should have avoided use of tricolor in the event.  

 

On 09-05-13,  Urvashi moved an application to  Police Station officer of Thana Talkatora to lodge a F.I.R. under the Prevention of Insult to National Honour Act 1971 and other relevant sections of I.P.C. against Subrata Roy, managing worker and chairman of Sahara India Pariwar & other staff and workers of Sahara India Parivaar    who were directly responsible for dishonoring the National Flag of INDIA .

 

Police Station officer of Thana Talkatora refused to entertain the application and directed Urvashi to contact Ashiyana Police Station. On 11-05-13,  Urvashi moved the  application to  Police Station officer of Thana Ashiyana. Police Station Ashiyana too refused to file the F.I.R. and Urvashi was compelled to move an application to S.S.P. of Lucknow.Application dated 15-05-13 to S.S.P. Lucknow was also of no avail so Urvashi  has now filed a case u/s 156(3) CrPc to get the F.I.R. registered  in this matter of gross disrespect to National Flag of India and the culprits be punished.

 

 

"I have informed the matter to Chief Secretary of Uttar Pradesh and DGP of Uttar Pradesh also but no action from their end is damn surprising to me and shows their lackluster attitude towards safeguarding the honor of National Symbols in Uttar Pradesh " told Urvashi.
