अखिलेश के मंत्री अब आरटीआई की सूचना के फेर में फंसे


लखनऊ।। अखिलेश सरकार के मंत्रियों की बेलगाम जुबान को लेकर विरोधी दल जहां सरकार पर हमलावर रवैया अपनाए हुए हैं, वहीं अब सामाजिक संगठनों से जुड़े लोग भी कानूनी रूप से सरकार की घेराबंदी में जुट गए हैं।

आरटीआई कार्यकर्ता उर्वशी शर्मा ने मुख्यमंत्री कार्यालय से राज्य सरकार के कई मंत्रियों के ऐसे ही विवादित और कानून को खुली चुनौती देते हुए दिए गए मामलों में दर्ज एफआईआर की जानकारी सूचना के अधिकार के तहत मांगी है।

राज्य के स्वास्थ्य मंत्री अहमद हसन ने मुरादाबाद में अपने भाषण में पूर्व मुख्यमंत्री मायावती पर सार्वजानिक रूप से जातिसूचक शब्द के साथ कटाक्ष किया था। अहमद हसन ने आरोप लगाया था कि विरोध न करने पर एक जाति विशेष के लोगों को ही प्रमोशन का लाभ मिलता।

उर्वशी ने कहा है कि अहमद हसन का यह कृत्य महिलाओं व अनुसूचित जाति के प्रति उनकी कुत्सित मानसिकता को सिद्ध करता है। उर्वशी ने अहमद हसन के विरुद्ध अनुसूचित जाति एवं जनजाति (अत्याचार निवारण) अधिनियम, महिला उत्पीड़न एवं भारतीय दंड संहिता की सुसंगत धाराओं में उत्तर प्रदेश सरकार द्वारा दर्ज कराई गयी प्रथम सूचना रिपोर्ट की सत्यापित प्रति मांगी है।

इसी तरह एक अन्य मंत्री शिव कुमार बेरिया द्वारा एटा में एक कार्यक्रम के दौरान प्रशासनिक अधिकारियों एवं पुलिस वालों को सरेआम धमकी देने और सार्वजानिक रूप से अपमान करने के मामले में भी प्रदेश सरकार द्वारा कराई गई जांच रिपोर्ट मांगी गई है।

सांडी विधायक राजेश्वरी देवी ने तो समाजवादी पार्टी सरकार के एक साल पूरे होने पर मनाए जा रहे उपलब्धि दिवस पर कार्यकताओं को अधिकारियों को सुधारने के लिए हाथ में चप्पल उठाने की जरूरत की नसीहत दे डाली।

उर्वशी ने मुख्यमंत्री कार्यालय से कहा है कि इस मामले में उस शासनादेश, अधिसूचना, नियम आदि की सत्यापित प्रति उन्हें मुहैया कराई जाए जिसके तहत एक विधायक अधिकारियों को चप्पल से मारने के लिए अधिकृत हैं। उन्होंने इस मामले में जांच और उसकी रिपोर्ट की प्रति भी मांगी है।

मंत्री राम मूर्ति वर्मा के बयान, 'उत्तर प्रदेश में अपराध को कोई भी ताकत नहीं रोक सकती।' को आधार बनाते हुए उर्वशी ने प्रदेश में अपराध को रोकने के लिए राज्य सरकार द्वारा 1 अप्रैल 12 से 24 अप्रैल 13 तक की अवधि में जारी किए गए शासनादेशों की सत्यापित प्रतियां दिए जाने का अनुरोध किया है।

इसी तरह पूर्व खादी एवं ग्रामोद्योग मंत्री राजाराम पांडेय को मंत्री पद से बर्खास्त किए जाने के प्रकरण से संबंधित पत्रावलियों की प्रति मांगी है।

गौरतलब है कि पांडेय ने प्रतापगढ़ में कहा था कि बेल्हा की सड़कें हेमा मालिनी के गालों की तरह चमकेंगी, अभी तो फेशियल हो रहा है। इससे पहले वह सुल्तानपुर की डीएम धनलक्ष्मी की खूबसूरती की सार्वजनिक रूप से तारीफ करने के कारण विवादों में आए थे।

MoF refuses to make commissioning letter for black money study public

The Union finance ministry has refused to make public the order for
commissioning a study to find out the quantum of black money floating
in the economy, saying it would be a breach of parliamentary
privileges.


Admitting that it does not have any "exact estimate" of black money
which is in circulation inside the country or abroad, the ministry
said it had commissioned a study to estimate the quantum of
unaccounted income/wealth inside and outside the country and its
ramifications on national security.

This was done on the basis of recommendations of Parliament's standing
committee on finance.

Why Akhilesh Yadav is showing special affection towards tainted IAS Sadakant ?

Lucknow: The Samajwadi Party government in Uttar Pradesh has always
been cornered by political parties for failing to control law and
order situation in the state and before the 2012 Assembly polls when
exit polls predicted the comeback of the party again it was the same
issue which was raised.

However, when the party stormed back to the power in the 2012 assembly
polls, the government claimed to have tightened the noose of the
miscreants and alleged party workers but again failed to deliver on
this front.

The game of crowning of the tainted minister and then shunting them
out to garner support and earn repute in the eye of the public, was
already being played, meanwhile, one more game plan was introduced; it
was reinstating the tainting official, last week in a major
administrative reshuffle, Sadakant Shukla was again handed the charge
of the department which saw him shunted to Central Home Ministry for
dubious work. Sadakant was sent back to the state before the
completion of his deputation.

Sadakant Shukla has the history of charges of colluding with the Land
Mafios. He was sent to Home Ministry as Joint Secretary but instead of
indulging in law and order, he allegedly got engaged in the business
of construction for alleged profit making.

Heard learned counsel for the State in this public interest litigation.
This public interest litigation is a result of suo-motu cognizance
taken by this Court of certain facts reported in a Newspaper dated
22nd March, 2013 disclosing as many as eight vacancies out of ten
posts of Information Commissioner in the State of Uttar Pradesh.
A counter affidavit has been brought on record on behalf of the
State of U.P. to explain as to why such a situation has arisen.
According to the counter affidavit certain provisions of the Right
to Information Act, 2005, a Central Act (hereinafter referred to as
'Act') were under challenge before the Apex Court in the case of
Namit Sharma vs. Union of India
and the Apex Court by its
judgement dated 13th September, 2012, reported in (2013) 1 SCC
745, issued a number of directions in order to make the Act
constitutionally valid as well as workable.

UPON hearing counsel the Court made the following
O R D E R
I.A.NO. 6 in R.P.(C) No. 2309 of 2012
This is an application for stay of the operation
of the judgment dated 13th September, 2012 passed in
Writ Petition (C) No. 210 of 2012 titled Namit Sharma
Vs. Union of India reported as 2013 (1) SCC 745 during
the pendency of the Review Petition (C) No. 2309 of
2012 titled Union of India Vs. Namit Sharma.
We have heard learned counsel for the parties and
we are not inclined to stay the operation of the entire
judgment in Namit Sharma Vs. Union of India but we
direct that the following directions in sub-paras 108.8
and 108.9 quoted here-in-below shall remain stayed
during the pendency of the Review Petition (C) No. 2309
of 2012.
108.8 The Information Commissions at
the respective levels shall henceforth
work in Benches of two members each.
One of them being a 'judicial member',
while the other an 'expert member'.
The judicial member should be a person
RP(C) 2309/2012 etc. 3
possessing a degree in law, having a
judicially trained mind and experience
in performing judicial functions. A
law officer or a lawyer may also be
eligible provided he is a person who
has practiced law at least for a period
of twenty years as on the date of the
advertisement. Such lawyer should also
have experience in social work. We are
of the considered view that the
competent authority should prefer a
person who is or has been a Judge of
the High Court for appointment as
Information Commissioners. Chief
Information Commissioner at the Centre
or State level shall only be a person
who is or has been a Chief Justice of
the High Court or a Judge of the
Supreme Court of India.
108.9 The appointment of the judicial
members to any of these posts shall be
made 'in consultation' with the Chief
Justice of India and Chief Justices of
the High Courts of the respective
States, as the case may be".
We further direct that wherever Chief Information
Commissioner is of the opinion that intricate questions
of law will have to be decided in a matter coming
before the Information Commissioners, he will ensure
that the matter is heard by a Bench of which at least
one member has knowledge and experience in the field of
Law.
We make it clear that subject to orders that may
be finally passed after hearing the Review Petitions,
the competent authority will continue to fill up the
vacant posts of Information Commissioners in accordance
with the Act and in accordance with the judgment in
RP(C) 2309/2012 etc. 4
W.P.(C) No. 210 of 2012 except sub-paras 108.8 and
108.9 which we have stayed. This is to ensure that
functioning of the Information Commissioners in
accordance with the Act and the Judgment is not
affected during the pendency of the Review Petitions.
We further make it clear that the Chief
Commissioners already functioning will continue to
function until the disposal of the Review Petitions.

UCKNOW: The Right to Information (RTI) Act has always been in bad shape in UP. The changing regimes have not done much to ameliorate the state of RTI affairs in the state. The biggest proof on that is defunct state of the state-level committee set up to review the implementation of RTI Act in the state. The committee which was constituted on July 7, 2008, and was intended to review the implementation of the Right to Information (RTI) Act has met on only three occasions till now whereas it was supposed to meet monthly/quarterly to take stock of RTI implementation...........................................................................................................

LUCKNOW: In what could be described as a double whammy for the
Congress, after Union home minister Sushilkumar Shinde made a U-turn
on his comments on Hindu terrorism, the ministry of home affairs did
not provide information about terror camps being operated by the
Rashtriya Swayamsevak Sangh and Bharatiya Janata Party, when asked
under the Right to Information (RTI) Act.

The ministry, instead, provided the copy of Shinde's clarification and
said the "home minister has issued a clarification on February 20,
clarifying the position."

The political furore over Shinde's comment on BJP and RSS conducting
terror camps, though died down after the minister tendered an apology,
caused embarrassment to the government. In an RTI response, the
ministry denied information. The questions could be irrelevant since
the minister has already apologised for his comment.

Shinde had said, during Congress' Jaipur conclave, in January, "We
have got an investigation report that be it the RSS or BJP, their
training camps are promoting Hindu terrorism." He later clarified that
he meant saffron and not Hindu terrorism. The comment was strong
enough to leave BJP livid, which demanded that the minister either
apologise or be sacked. Shinde later backpedalled and retracted his
statement by issuing a clarification and also regretting his
statement.

In January, activist Urvashi Sharma had sought certified copies of all
records available with the government based on which the home minister
had accused RSS and BJP of conducting terror training camps and
promoting "Hindu terrorism", from the PMO. The response which came
more than two months after the application was made, said the
government has no records available on any of the information sought.

The query had also sought certified copies of information on location
within India and/or abroad of RSS and BJP terror training camps;
certified copies of records available with the government on action
taken against BJP and RSS to ban them for running terror training
camps; certified copies of prevailing national/international
rules/regulations/treaties/
Government Orders as per which "terrorism"
has been divided on the basis of religion/caste/creed/sect etc.;
certified copies of list and all records available with the government
on cases of infiltration and/or insurgency and case wise actions taken
by government.
